How to Play

To play “The Great Security Caper,” look for clues in Bytware print ads, web ads, and newsletter sponsorships, and in news articles appearing on the website of The Houston Record (www.houstonrecord.com). When you believe you know who stole the research data, submit your guess using the online form on the Bytware website. Only one guess per person is allowed. Contest void where prohibited by law.

The Guilty Party Guarantee
The guilty party, method, and place of the crime for “The Great Security Caper” has been pre-determined by the contest creator and sealed in an envelope to be opened on or after April 29, 2005. Although new information and clues will be released throughout the year, the guilty party, method, and place of the crime will not be changed during the course of the contest.

Eligibility
“The Great Security Caper” is intended for the iSeries community and companies who use the iSeries platform. You will be required to show proof of iSeries ownership when submitting your accusation. Ownership and/or use of Bytware products in NOT a requirement for participation. Winners may be required to sign and return an Affidavit of Eligibility with a liability release within seven (7) days of notification via e-mail from Bytware, Inc., of their winning entry, except where prohibited by law. Employees of Bytware, Inc., its subsidiaries, divisions, affiliates, distributors, suppliers, and advertising, promotional or other contest sponsors and promotional parties, and the immediate family members of such employees and/or persons living within the same household as such employees are not eligible to win. Limit one prize per person. You must be 21 years of age or older to win.

Entries
Entries must be submitted through the online entry form. All fields are required. You will be required to show proof of iSeries ownership when submitting your accusation. Only one entry per person is allowed. Entries will be time-stamped and subsequent entries by the same person after the first confirmed entry will be discarded. Receipt of entries will be confirmed by Bytware, Inc., via an e-mail receipt. If confirmation receipt has not been received within two (2) business days, participant should resubmit entry online. Bytware, Inc., is not responsible for lost entries.

Prizes
All entries correctly accusing the data thief will win a prize, to be determined by Bytware. Prize subject to change without notice. Correct entries will then be entered into a drawing for the grand prize of an Apple iPod. Grand prize winner will be selected at random from correct entries. Grand prize winner may specify the preferred iPod platform, either Windows or Macintosh. All unclaimed prizes will be forfeited. In the event that no correct entries are received, all submitted entries will be put into a drawing for the Apple iPod. Contest End
“The Great Security Caper” is scheduled to end and entries must be submitted no later than April 29, 2005.

Winners List
Contest winners will be announced on the Bytware website on May 3, 2005, and will also appear in the May/June 2005 issue of the Bytware News monthly newsletter. A list of winners via e-mail may also be requested by submitting an online request to Bytware Marketing at http://www.bytware.com/contact/contact_marketing.html

Disqualification
Persons found tampering with any aspect of the contest, including but not limited to submitting multiple entries under different identities, will be immediately disqualified.

Release of Liability
All winners, by acceptance of prize, agree to release Bytware, Inc., from any and all liability, claims or actions of any kind whatsoever for injuries, damages, losses, or workplace/job-related issues of any kind to persons or property which may be sustained in connection with the receipt, ownership, or use of the prize or while preparing for and/or participating in and/or traveling to and/or from any prize-related activity, including searching for clues in contest materials in print and online, or any typographical or other error in the Official Rules or the offering and announcement of prizes. Bytware, Inc., makes no representations or warranties of any kind concerning the appearance, safety or performance of any prize. The winner shall bear all risk of loss or damage to prize after it has been delivered. As contest is conducted largely online, Bytware, Inc., is not responsible for lost, interrupted or unavailable communications, failed servers, interrupted telephone or computer transmissions, or technical failure, whether caused by human or machine. Upon request, winner must consent, and confirm such consent in writing, to the use of his/her name, voice photo, or other likeness without compensation for promotional purposes in all media determined by Bytware, Inc., except where prohibited by law, and waive any right to remuneration for such use.

Other Conditions
Substitution of prizes offered is not permitted. Non-cash prizes may not be redeemed or exchanged for cash value, except as determined by Bytware, Inc., at its sole discretion. If applicable, winner may receive an IRS Form 1099 for the retail value of the prize. All participants agree to be bound by these Official Rules. All decisions of Bytware, Inc., with regard to contest development, promotion, and winner are considered final and binding.
